1. Legally, Brian is right. She did give him her poem, and the cpywrite would have expired. Only if there was more than just the poem, like a date or a name, she might still get some credit for the song.
2. Morrally, he's wrong. He cannot take a song that somebody wrote, even as a gift, without at least giving them a heads up.
Maybe if the work together, she might become an accomplished writer.

I agree with your thoughts on whether Brain was right to get the song. I also think that they should find a way that they can both get something out of the song.
